Florida Man Files Lawsuit Against Costco Over Listeria-Infected Chicken Wrap

FEBRUARY 13, 2024 – A legal battle is unfolding as Florida resident, Kyle D., takes legal action against Costco after falling victim to Listeria contamination from their Chicken Wrap products.

Allegedly, Kyle purchased multiple Southwest Chicken Wraps from a Costco store in Pompano Beach, FL, containing ingredients sourced from Rizo-Lopez Foods. In January 2024, he reported severe symptoms, including body pain and an unusual discharge from his belly button. Following surgery, he received a diagnosis confirming a bacterial infection caused by Listeria.

This incident coincided with a broader outbreak of Listeria traced back to dairy products produced by Rizo-Lopez Foods. Fresh Creative Foods took swift action on February 7, recalling cotija cheese – a component of the ill-fated Southwest Chicken Wraps.

Costco responded promptly by issuing a nationwide recall notice to customers, cautioning against the potential contamination of their Southwest Chicken Wraps with Listeria monocytogenes.

The lawsuit commenced on February 9, 2024, with Kyle filing a lawsuit against Costco in the U.S. District Court for the Southern District of Florida, Miami Division, under Case 0:24-cv-60231.
